Terms of Use

We may update these Terms from time to time. We will post the current version on this page and update the “Last updated” date. Material changes may be communicated by email or a notice in the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to changes, you must stop using the Service and may close your account.

• You must be at least 16 years old to use the Service.
• You must provide accurate registration information (including a valid email address) and keep it current.
• Credentials (email and password) are for your account only and must not be shared with others. You are responsible for all activity under your account and for safeguarding your password. We are not liable for losses arising from your failure to protect your account.
• Serious or repeated breach of these Terms may result in suspension or termination of your account, at our reasonable discretion.

You agree not to:

• Send unsolicited or bulk messaging, spam, or abusive notifications through the Service, or use the Service to harass, threaten, or harm others.
• Introduce malware, viruses, or code intended to disrupt, damage, or gain unauthorized access to systems or data.
• Use the Service for any illegal purpose or in violation of applicable law or third-party rights.
• Attempt to probe, scan, or test the vulnerability of the Service, or circumvent technical limits, rate limits, or authentication, except as expressly permitted.
• Resell, sublicense, or commercially exploit access to the Service without our prior written consent, or use automated means to access the Service in a way that imposes an unreasonable load.

• We may modify, suspend, or discontinue features of the Service with or without notice. We may refuse service to anyone for legitimate reasons (for example, fraud prevention or abuse).
• The Service is provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that notifications will be delivered at a specific time or without loss. Third-party platforms (such as mobile OS push services) are outside our control.
• Support is provided on a reasonable-efforts basis through channels we designate (for example, email).
• The Service relies on third-party infrastructure (hosting, messaging providers, payment processors, and similar vendors). Your use of the Service is subject to their terms and availability where applicable.
• We may remove or restrict content or accounts that we reasonably believe violate these Terms, applicable law, or the rights of others.

To the maximum extent permitted by applicable law, PushNotifiMe and its affiliates, officers, directors, and employees will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including lost profits, goodwill, data, or other intangible losses, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the claim, or (b) fifty U.S. dollars (USD), if you have not paid fees. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

If you purchase paid features, fees are as shown at checkout or in your account. Fees are exclusive of taxes, duties, and levies, which you are responsible for where applicable. Promotional pricing or credits may change if you upgrade, downgrade, or cancel your plan as described at the time of offer.

To protect the Service and other users, we may impose reasonable limits on API calls, message rate, monthly quotas, concurrent connections, and similar usage. Limits may be published in documentation or the dashboard and may change. You must not use multiple accounts, tokens, or workarounds to circumvent limits. We may throttle or suspend service that unreasonably exceeds limits or degrades the Service for others.

• You may stop using the Service and request closure of your account as described in your account settings or by contacting support.
• Upon termination or cancellation, your right to use the Service ends. We may delete your data in line with our Privacy Policy and retention practices; some data may remain in backups for a limited period.
• We may suspend or terminate your account if you violate these Terms, create risk or legal exposure, or for other material reasons.
• Abusive behavior toward our users, staff, or partners (including threats) may result in immediate termination.

These Terms, together with our Privacy Policy and any policies or terms referenced when you purchase a feature, constitute the entire agreement between you and PushNotifiMe regarding the Service and supersede prior agreements on the same subject. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, except where mandatory consumer protections in your country of residence apply. Disputes will be resolved in the courts located in the United States, unless applicable law requires otherwise.
